REFUND_POLICY

1. Refund Eligibility

designwavehub operates a milestone-based payment structure. Refunds are evaluated based on the completion status of project phases and the nature of any service dissatisfaction.

2. Pre-Development Cancellation

If cancellation occurs before any development work has commenced, a full refund of any advance payments will be processed within 14 business days, minus any administrative fees (maximum 10% of the total payment).

3. Mid-Project Cancellation

If cancellation occurs during an active project phase:

  • Completed milestones are non-refundable
  • Partial refunds may be issued for incomplete work within the current milestone
  • All deliverables completed to date will be transferred to the client

4. Post-Completion Disputes

If significant deviations from agreed specifications are identified within 30 days of project completion, designwavehub will undertake reasonable remediation efforts. If remediation is not feasible, a partial refund may be negotiated based on the scope of deviation.

5. Refund Process

Refund requests must be submitted in writing to [email protected] within 30 days of the relevant milestone or project completion. Requests will be reviewed within 5 business days, and approved refunds will be processed within 14 business days.

6. Non-Refundable Items

The following are not eligible for refunds:

  • Third-party licenses or subscriptions procured on behalf of the client
  • Domain registration or hosting fees
  • Work completed and approved during the project lifecycle

TERMS_OF_SERVICE

1. Agreement to Terms

By accessing or using the services provided by designwavehub, located at Avinguda Diagonal 405, Barcelona, Gràcia, España, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Scope of Services

designwavehub provides web design, development, and related digital services as described in individual project proposals and statements of work. The specific scope, deliverables, timeline, and pricing for each project are defined in separate agreements.

3. Client Responsibilities

Clients are responsible for:

  • Providing timely feedback, approvals, and required materials
  • Ensuring they have rights to all content provided for use in projects
  • Maintaining confidentiality of project access credentials
  • Timely payment according to agreed milestone schedules

4. Intellectual Property

Upon full payment, all intellectual property rights for custom work created specifically for the client are transferred to the client. designwavehub retains the right to display work in portfolios and marketing materials unless otherwise agreed. Pre-existing tools, frameworks, and code libraries remain the property of designwavehub.

5. Payment Terms

Invoices are payable within 14 days of issuance unless otherwise specified. Late payments may incur a fee of 1.5% per month on the outstanding balance. designwavehub reserves the right to suspend work on any project with payments more than 30 days overdue.

6. Limitation of Liability

designwavehub's total liability for any project shall not exceed the total fees paid for that specific project. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.

7. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of the project. This obligation survives the termination of the professional relationship for a period of 24 months.

8. Termination

Either party may terminate a project with 14 days written notice. Upon termination, the client will receive all completed work and will be invoiced for any outstanding milestones. Unused advance payments will be refunded in accordance with our Refund Policy.

9. Governing Law

These Terms of Service are governed by the laws of Spain. Any disputes shall be resolved through negotiation, and if unresolved, through binding arbitration in Barcelona, España.

10. Modifications

designwavehub reserves the right to modify these terms at any time. Continued use of our services following any changes constitutes acceptance of the modified terms. Clients will be notified of significant changes via email.
